Terrafold End User Licence Agreement
EULA version 1.0, 19 October 2026
Please read this agreement before you install or use Terrafold. By installing, starting or using the software you accept this agreement. If you do not accept it, do not install or use the software.
1. Parties
1.1. The licensor is Appmire CommV, Langestraat 116, 1790 Affligem, Belgium, enterprise and VAT number BE 0535.825.723, contact terrafold@appmire.be ("Appmire", "we").
1.2. The licensee is the person or the legal entity that installs or uses the software ("you").
1.3. "The software" means Terrafold in every form we make available (desktop app, command-line tool, web version), including updates we provide, its documentation and its built-in content.
2. Licence grant
2.1. Appmire grants you a non-exclusive, non-transferable, personal right to use the software under this agreement and under the terms of your licence key.
2.2. A perpetual licence lets you use the software forever. It includes the versions of the software released during the update period stated in your licence key (normally one year from the date of issue). Versions released after that period are not covered by it.
2.3. A subscription licence lets you use the software until the end date stated in your licence key, plus a grace period of 14 days.
2.4. Without a licence key you may use the full software as a trial for 30 days from the first start. After the trial, or when your licence does not cover the version you use, the software runs in viewer mode: you can open, view, navigate and print models and export images, but you cannot save models or export models or data.
2.5. A licence is not tied to a computer, but it is personal: it belongs to the one licensee named in the licence key. The licensee may install the software on the computers they use; the licence may not be shared with or used by anyone else.
3. Restrictions
3.1. You may not:
- copy the software, except to install it and to make backups;
- distribute, sell, resell, rent, lend, lease or sublicense the software or a licence key, or make it available to third parties in any other way;
- reverse engineer, decompile or disassemble the software, or circumvent, disable or tamper with its licence checks, except where and to the extent that applicable law expressly allows this despite this restriction;
- remove or change copyright notices, trademarks or other notices in the software.
4. Ownership
4.1. The software is licensed, not sold. Appmire and its licensors keep all rights, title and interest in the software, including all intellectual property rights. Rights not expressly granted in this agreement are reserved.
4.2. The software includes third-party components that are licensed under their own licences. These licences are listed in THIRD-PARTY-NOTICES.txt, which comes with the software. Nothing in this agreement limits your rights under those licences.
5. Your content
5.1. The models, drawings, images and other files you make with the software belong to you. Appmire claims no rights in them.
6. No warranty
6.1. THE SOFTWARE, ITS DOCUMENTATION, THE WEBSITE AND EVERYTHING THE SOFTWARE PRODUCES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OR GUARANTEE OF ANY KIND, EXPRESS OR IMPLIED. IN PARTICULAR, APPMIRE GIVES NO WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, AVAILABILITY, UNINTERRUPTED OR ERROR-FREE OPERATION, OR PRESERVATION OF DATA.
6.2. You are responsible for keeping your own backups of your work.
7. No rights can be derived
7.1. No rights can be derived from the software, its output, the documentation, the website, roadmaps, announcements, or any communication about features, updates, support or availability.
8. Not professional advice
8.1. All calculations and output of the software, including terrain grading, cut and fill and excavation volumes, water volumes, retaining walls, steps and ramps, quantities, plant data and growth, shadows and measurements, are estimates for visualisation and design only.
8.2. They must be checked by a qualified professional before any construction, earthwork, purchase or other decision is based on them. You alone are responsible for the use you make of them.
9. Exclusion of liability
9.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPMIRE, ITS MANAGER, EMPLOYEES AND SUPPLIERS ARE NOT LIABLE FOR ANY DAMAGE WHATSOEVER, DIRECT OR INDIRECT, INCLUDING LOSS OF DATA, PROFIT, REVENUE, BUSINESS OR GOODWILL, BUSINESS INTERRUPTION, DAMAGE TO PROPERTY, OR THE COST OF SUBSTITUTE GOODS, ARISING FROM THE USE OF, OR THE INABILITY TO USE, THE SOFTWARE OR ITS OUTPUT, EVEN IF APPMIRE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
10. Limitation of liability
10.1. Where liability cannot be excluded, Appmire's total liability is limited to the amount you actually paid for your licence in the 12 months before the event that caused the damage. For the trial and viewer mode, which are free of charge, this amount is zero, as far as the law allows.
11. Liability that cannot be limited
11.1. Nothing in this agreement excludes or limits liability that cannot be excluded or limited under the applicable law, such as liability for intent or fraud, liability for death or personal injury, or the mandatory rights of consumers, including the legal guarantee of conformity for digital content. If you are a consumer, these mandatory rights apply in addition to this agreement.
12. Updates and support
12.1. Appmire does not promise updates, upgrades or support. Any updates or support Appmire provides are given at its discretion and fall under this agreement.
13. Termination
13.1. This agreement and your licence end automatically if you breach this agreement.
13.2. When the agreement ends, you must stop using the software and delete all copies of it.
13.3. Sections 4 (Ownership), 6 to 11 (warranty and liability) and 15 (Governing law and courts) remain in force after the agreement ends.
14. Export and compliance with the law
14.1. You must comply with all export control, sanctions and other laws that apply to your use of the software.
15. Governing law and courts
15.1. This agreement is governed by Belgian law, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
15.2. The competent courts of the judicial district of Appmire's registered office have exclusive jurisdiction, without prejudice to mandatory rules on the jurisdiction of courts for consumers.
16. Entire agreement and severability
16.1. This agreement, together with your licence key, is the entire agreement between you and Appmire about the software. It replaces all earlier agreements and communications about it.
16.2. If a clause of this agreement is invalid or unenforceable, it is replaced by a valid clause that comes closest to its intent, and the rest of the agreement stays in force.
17. Version
17.1. This is EULA version 1.0 of 19 October 2026. When Appmire changes this agreement, the software asks you to accept the new version.
